Justice Department Appeals Judge’s Ban on Tree-Cutting at East Potomac Golf Course

President Donald Trump said his administration would appeal the “unconstitutional” decision by the federal judge.

The Justice Department is appealing a federal judge’s order blocking further tree removal at D.C.’s East Potomac Golf Course, escalating the fight over President Donald Trump’s planned overhaul of the historic public course.

U.S. District Judge Ana Reyes issued the injunction Monday in a scathing opinion finding that challengers — a preservation group and golfers — were likely to prove the administration violated federal environmental law. Her order also requires 10 business days’ notice before other irreversible changes to East Potomac Park.

The government is now seeking to have that ruling overturned by a panel of judges in the U.S. Court of Appeals for the District of Columbia. The two-page notice does not explain the administration’s arguments for overturning the ruling.

Trump blasted Reyes late Monday, and announced that he’d appeal the judge’s “unconstitutional” decision.
